CONTROL OF THE EXPORT OF MISLABELLED PRODUCTS AND
EQUIPMENT WHOSE CONTINUING FUNCTIONING RELIES
ON ANNEX A AND ANNEX B SUBSTANCES
Draft decision proposed by Antigua and Barbuda and Barbados
on behalf of the Caribbean countries
Recognizing that continued trade in products, equipment, components and technology whose continued functioning relies on the supply of substances listed in Annex A and Annex B of the Montreal Protocol could seriously impact on the ability of countries operating under paragraph 1 of Article 5 to meet their commitments under Article 2 of the Protocol,
Understanding the importance of control of trade in products containing ozone-depleting substances in all Parties (and especially low-volume-consuming countries) in view of the need for global implementation of the provisions of the Protocol,
Acknowledging that control of the trade in products containing ozone-depleting substances listed in Annex A and Annex B of the Protocol is problematic owing to difficulties in identification and testing of such equipment, and lack of resources for testing such equipment, and that most of these problems can be approached only by concerted action undertaken at the international level,
Recalling the terms of decisions IX/9 and X/9,
The Twelfth Meeting of the Parties decides:
1. To request Parties to submit to the Secretariat information concerning those measures that have been adopted to meet the recommendations contained in decision IX/9;
2. To request the Secretariat to report to the Thirteenth Meeting of the Parties on those measures that have been adopted by the Parties in response to the recommendations contained in decision IX/9;
3. To acknowledge that the issue of imports and exports of mislabelled products and equipment whose continued functioning relies on Annex A and Annex B substances should be further considered at the Thirteenth Meeting of the Parties with a view to addressing more specifically the concerns of countries in the process of phasing out importation of those products and equipment.
