Inspection Powers in The Gambia

The Hazardous Chemicals and Pesticides Control and Management Act provides that inspectors have broad powers to investigate potential violations of laws governing pesticides and other hazardous chemicals. Under this Act, any “inspector may, in the performance of his duties . . . at all reasonable times without [a] warrant enter on any land, premises or vehicle, where a chemical or pesticide is or may be reasonably suspected to be manufactured, stored, sold, distributed or used to determine whether the provisions of this Act are being complied with.” Moreover, the “inspector can also take samples of any article and substances under this Act and submit them for analyses.”
