6.4 Environmental Restoration Orders
Uganda has this enforcement provisions
in its Environmental Statute. These provisions may also be introduced
in the other countries. The purposes of the
environmental restoration order may be four-fold:
(i) to prevent actions which are likely to harm the environment;
(ii) to require restoration of the environment;
(iii) to compensate persons adversely affected by an action; and,
(iv) to reimburse government or other parties who have undertaken restoration
work.
Before issuing the order it will be the duty of environmental institutions
to prove that no harm has been done, on the environment or is likely
to be done on the environment by a person performing such act.
